Terms of Use

By accessing, registering on, or using DueSure, your organization ("Client" or "DNFBP User") agrees to be bound by these Terms of Use, our Privacy Policy, and all applicable laws of the Federal Republic of Nigeria, including the MLPPA 2022 and NDPA 2023.

1. You represent and warrant that your organization is a legitimate DNFB&P (Designated Non-Financial Business & Professional operating in Nigeria (e.g., real estate firm, law practice, car dealership, luxury goods store, accounting practice, or gaming operator) or an authorized corporate entity.

2. You warrant that you will use this platform strictly for lawful anti-money laundering, counter-terrorist financing compliance, and Know Your Customer (KYC) verification.

1. You explicitly covenant and guarantee that your organization has obtained prior, unambiguous, and documented consent from every customer or corporate entity whose data you submit for screening, in compliance with Section 22 of the NDPA 2023.

2. You acknowledge that running unauthorized, malicious, or non-consensual searches on individuals violates Nigerian privacy laws and will result in immediate account termination and potential legal liability.

1. You are responsible for maintaining the confidentiality of your account credentials, Multi-Factor Authentication (MFA) tokens, and Role-Based Access Control (RBAC) assignments.

2. You must notify us immediately of any unauthorized access or security breach affecting your work-space/station.

1. Credit-Based & Recurring Tiers: Services are billed via approved payment platform on a recurring monthly/annual subscription or a pay-per-search credit bundle model.

2. Non-Refundable Credits: Purchased search credits and subscription fees are non-refundable once credited or utilized. Unused credits expire at the end of billing cycles unless stated otherwise in custom enterprise agreements.

1. All platform software, fuzzy-matching algorithms, user interfaces, and database architectures are the exclusive property of DueSure.

2. Generated PDF Due Diligence Reports and cryptographic audit certificates are licensed to your organization for internal compliance and inspection purposes only. Reselling, tampering with, or falsifying audit certificate checksums is strictly prohibited.

1. Screening results are aggregated from authoritative government registers, global watchlists, and public news sources. While we strive for 100% accuracy, we do not warrant that underlying public database are completely free of errors or real-time latency.

2. DueSure shall not be held liable for business decisions, transaction approvals, or regulatory fines incurred by your DNFBP organization based on screening hits or false positives. Final compliance adjudication rests solely with your designated compliance officer.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising herefrom shall be settled through binding arbitration in Rivers State, Nigeria, in accordance with the Arbitration and Mediation Act.
